1. Scope and Seller

1.1 These General Terms and Conditions (hereinafter "Terms") apply to all contracts concluded via the online store cinem8.co between

CINEM8.CO, Owner: Christian Grab
THE VOID c/o Impressumservice Dein-Impressum
Stettiner Straße 41
35410 Hungen, Germany
Email: info@cinem8.co
(hereinafter "we" or "us")

and our customers (hereinafter "you"), in the version valid at the time of the order.

1.2 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or profession.

1.3 Deviating terms of the customer do not apply unless we expressly agree to them in writing.

2. Products and Product Descriptions

2.1 We exclusively sell digital products that are delivered as downloads, in particular LUTs, presets, PowerGrades, DCTLs, transitions, overlays, textures, sound effects and the EMUL8 film emulation plugins for Final Cut Pro and DaVinci Resolve Studio. We do not sell physical goods.

2.2 The presentation of products in the online store is not a legally binding offer but an invitation to place an order.

2.3 The system requirements of each product (for example the supported software and its minimum version, the operating system and the hardware) are stated on the respective product page. Please check them before you buy. A product that does not run on a system that does not meet the stated requirements is not defective.

3. Order Process and Conclusion of the Contract

3.1 You can add products to the shopping cart by clicking the add to cart button. In the shopping cart you can review your selection and remove products. Each product can be purchased once per order.

3.2 By clicking the checkout button in the shopping cart, or one of the express payment buttons (for example Shop Pay, PayPal, Apple Pay or Google Pay), you proceed to the checkout. There you enter your email address and billing details and choose a payment method. Before you place your order, you can review all of your details and correct input errors at any time, or return to the shopping cart.

3.3 By clicking the final order button in the checkout (for example "Pay now"), you submit a binding offer to purchase the products in your shopping cart.

3.4 The contract is concluded when we accept your offer. We accept it by sending you the order confirmation by email. Immediately afterwards, you receive access to your downloads by email and in your customer account. If the payment is not completed, no contract is concluded.

3.5 We store the contract text. You receive the order details by email with the order confirmation. These Terms are available on our website at any time and can be saved or printed.

4. Prices and Payment

4.1 All prices for consumers include the statutory value added tax where applicable. The tax applicable to your country is shown in the checkout. There are no shipping costs.

4.2 You can choose from the payment methods offered in the checkout. Payment is due immediately when you place the order. If a payment service provider is used (for example PayPal), their terms also apply.

4.3 Discount codes can be redeemed in the checkout according to their conditions. Unless stated otherwise, they cannot be combined with other discounts, cannot be redeemed retroactively for orders already placed and cannot be exchanged for cash.

5. Delivery, Downloads and Updates

5.1 Delivery takes place digitally. Immediately after your payment has been confirmed, you receive access to your products via the download links that we send you by email and in your customer account.

5.2 We recommend saving the downloaded files in a secure location. As long as we offer a product, you can download it again from your customer account.

5.3 Where a product page states that updates are included (for example "lifetime updates" for EMUL8), you receive all updates of the purchased product free of charge for as long as we develop and offer the product. We inform you about new versions by email. Statutory update obligations remain unaffected.

6. Licenses and Rights of Use

6.1 With the purchase you acquire a simple (non-exclusive), non-transferable, perpetual license to use the product according to the license purchased. All copyrights and other rights to the products remain with us. The photos, videos and other works you create with our products belong to you.

6.2 Creator License: for individuals, freelancers, YouTubers and production teams with fewer than six people. Commercial use in your own projects and in client projects is included. The license is granted per user, not per device: the licensed user may install the product on all computers they personally own.

6.3 Business License: required for companies, agencies, studios and organizations with six or more employees, and for use across multiple workstations of an organization. It allows unlimited internal use within the licensed company.

6.4 Products without a license choice may be used by the purchaser for personal and commercial projects under the terms of the Creator License.

6.5 The following is not permitted: reselling, sharing, lending or otherwise passing on the products or license; making the files available to third parties (for example via upload, file sharing or shared drives); including the products, in whole or in part, in other products that are sold or distributed free of charge (for example LUT packs, presets, templates or plugins); and decompiling or reverse engineering the software, except where permitted by mandatory law.

6.6 Not for resale (NFR) licenses that we provide free of charge, for example to reviewers or educators, may only be used for non-commercial purposes.

6.7 If you violate these license terms, we may revoke the license. Further claims remain reserved.

7. Right of Withdrawal for Consumers

7.1 Consumers have a statutory right of withdrawal. For the delivery of digital content, this right expires early once we begin to perform the contract, as described in the cancellation policy below.

7.2 When placing your order, you expressly request that we begin providing the digital content immediately, before the end of the withdrawal period, and you confirm that you are aware that you lose your right of withdrawal once we begin. We confirm this to you in the order confirmation email.

7.3 Business customers have no right of withdrawal.

Cancellation Policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (CINEM8.CO, Owner: Christian Grab, THE VOID c/o Impressumservice Dein-Impressum, Stettiner Straße 41, 35410 Hungen, Germany, email: info@cinem8.co) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You can also use the withdrawal function on our website at cinem8.co/pages/withdrawal. You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal

In the case of a contract for the delivery of digital content that is not supplied on a tangible medium, the right of withdrawal expires as soon as we have begun to perform the contract (by providing the download), after you have expressly consented to us beginning the performance of the contract before the end of the withdrawal period, you have confirmed your knowledge that you lose your right of withdrawal through this consent once we begin to perform the contract, and we have provided you with a confirmation of the contract on a durable medium.

8. Warranty for Defects

8.1 The statutory warranty rights apply. For digital products, this includes our statutory obligation to provide updates that are necessary to maintain the conformity of the product.

8.2 If you experience a problem, please contact us at info@cinem8.co with a description and details of your system (software version, operating system, hardware). This helps us to find a solution quickly.

8.3 For business customers, the limitation period for claims for defects is one year from delivery. We remedy defects for business customers at our discretion by repair or replacement.

9. Liability

9.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and within the scope of a guarantee we have given.

9.2 In the case of slightly negligent breach of an essential contractual obligation (an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract. Otherwise, we are not liable for slight negligence.

9.3 These limitations also apply to the personal liability of our employees, representatives and vicarious agents.

10. Customer Account

Your purchases and downloads are available in your customer account, which you access with your email address. Please keep access to your email account secure and do not share access to your customer account with third parties.

11. Final Provisions

11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

11.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our place of business.

11.3 The contract language is the language selected in our online store at the time of the order (English, German, Spanish, French, Japanese, Polish or Portuguese).

11.4 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11.5 Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
